Terms of Service

Last updated: 2026-08-08

By creating an XBuyer account or using our platform (including the Agent API), you agree to these terms. If you use XBuyer on behalf of an organization, you represent that you have authority to bind it.

1. Eligibility

You must be at least 18 years old and legally able to enter contracts in your jurisdiction. Accounts are for individuals or authorized business representatives.

2. The wallet & agent model

  • Wallet isolation: agents transact only from a wallet balance you fund. Your payment card is not exposed to any agent.
  • Authorization: you set spending limits and approve purchases (or a policy you define). You may revoke an agent's access at any time.
  • Your responsibility: you are responsible for transactions your account or authorized agents perform within your set limits.

3. Acceptable use

  • Do not use XBuyer for illegal goods, fraud, or to circumvent export controls.
  • Agents must operate strictly within the authorization and limits you grant; you may not instruct an agent to exceed them.
  • Do not abuse, reverse-engineer, or attempt to overwhelm the platform.

4. Orders, pricing & fulfillment

Listed prices include a transparent markup over supplier cost. Items ship from a global supplier network; estimated delivery is typically 11–13 days but is not guaranteed. Displayed estimates are our best forecast, not a delivery promise.

5. Payments & escrow

Funds are held in escrow and released against verified fulfillment. Refunds return to your wallet balance per our Returns & Refund Policy.

6. Intellectual property

XBuyer trademarks, software, and content are owned by XBuyer Inc. or its licensors. Our Agent API and MCP examples are provided under their respective licenses for integration use.

7. Limitation of liability

The platform is provided "as is." To the maximum extent permitted by law, XBuyer is not liable for indirect or consequential damages. Our total liability is limited to the amount of the relevant order or your wallet balance, whichever is greater.

8. Suspension & termination

We may suspend or close accounts that violate these terms or applicable law, with notice where practicable. You may close your account at any time.

9. Governing law

These terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles. Disputes are resolved by binding arbitration where permitted by law.
